Rep Power: 19 | Boy, I don’t get this whole take it out of their paycheck thing. If employee (A) who’s NOT your top performer and has had some issues, quits with a BIG FU, and doesn’t turn in their key, you bing their paycheck for the cost of re-keying the entire salon? If employee (B) who IS your top performer and has had No issues, resigns properly, but has lost their key, do you still bing their paycheck for the cost of re-keying the entire salon? If NOT. How do you justify that to a state auditor or lawyer in small claims court? If employee (C) who’s NOT your top performer and has had some issues, quits with a BIG FU, but turns in their key, do you foot the bill for the cost of re-keying the entire salon? If not, HOW do you know that the key employee (C) turned in wasn’t a copy? So then do you re-key after every employee? Is binging their paycheck legal? I don’t know check with your state. Legal or not, as a TSO do you have the “Power” to? Sure. But in light of a better option, why would you? Tom |

Rep Power: 0 | I have a policy that when I hire an employee and they are given a key, they sign an agreement, that they are to return the key upon quitting or termination, if they do not do this, they are liable to reimburse me for $125 service call for a locksmith and that I hold their last check until this is paid. Never had any problems with it. |

But for TSOs following this post, setting aside the issue of “fairness” to ex-employees, and the impact the “fairness” issue may have on current employees, I don’t know but I didn’t believe it was possible that any civil agreement or contract CAN be written to over-ride a state law. What happens when an employee turns in their key, you spend $125 service call to a locksmith for EVERY departure, or “Pray” the employee didn’t make a copy with bad intensions? Rep Power: 24 | Tommy is right , check with YOUR local labor dept, if I did any of the above here in Calif, you can bet for sure that I would pay the price. have already been to the labor board once & paid out some $$$$ for not paying on time. as far as the key thing don't bother they can get a copy almost anywhere i just have the lock rekeyed every time not worth wondering all night. if they quit then I 72 hrs to pay and if I fire them then I have to have the check ready right then & there. then fine is $30 a day up to 30 days !! |

Rep Power: 20 | we dont have to pay within 72hrs, we have to pay on the normal pay schedule, If they leave on a monday they get paid on friday with everyone else. (if I paid every 2 weeks they would still have to wait until the pay period ended, unless I wanted to be nice and pay them early.) |

Rep Power: 19 | ALOHATANCA, You have to admit that Cali has some of the toughest labor laws in the county and dealing with any state labor board is NO fun at all. I think the reason that labor laws exist in the first place is a good one, some owners just can’t seem to “find it in their heart” to see employees as people and don’t play fair. It takes less time and ZERO money to change the combination on a “combination door lock” than it does to call and order a $125.00 service call with a locksmith. Why take a chance on whether it’s legal, if an ex made $2.00 key copy, or is your current employees (the great ones you need) think it is fair treatment. Change the combination and sell some tans.
