Have you ever been audited by the Dept of Labor in your state? I know I touched on HR issues earlier... not much response. Most people aren't aware of what is the proper way to hire and pay their employees without taking a class of some kind.

So... what do you do when suddenly an inspector from the Department of Labor shows up? It happened to us. We passed with flying colors. Would you know what to do? Or... would you get caught with your pants down?

We got audited a few years back by the state to be sure we were in fact paying the employees and not doing it under the table. All they did was ask to see our payroll ledgers and general ledgers. No big deal. It is a big deal if in fact you are paying under the table and cheating in other ways. Of course if you are doing those things you deserve you burn.

Let me tell you how we got flagged for investigation. An employee was working for the salon while on disability from her regular job. TURNED out she just happened to work for the Department of Labor. She had surgery on her thumbs for carpal tunnel syndrome and wasn't supposed to be working anywhere. She wasn't the type of person to be quiet... so word got around when she returned to work that she had been working at the salon. In actuality, it wasn't really the salon that was being investigated... it was this woman. Thankfully we were able to prove that she never worked alone and she only sat the counter while on shift. This was not a breech of her disability. Now... had they had proof she had done more than sit and well... she would have been in trouble, not the salon.

Bstar you said it well, as long as you are honest you have nothing to worry about, it was not the salon they were after.

I have been audited provinciality twice.
I asked if they would like to come in on a day I was closed so they would not be interrupted and I would be fully availible.

I'm still new at this whole game and hope that I'm doing it right, but honestly Texas Workforce has not been especially friendly to me when I call with a question.

My pants would be down, but not because I didn't try to hitch them up.

The TX Workforce Commission and Dept of Labor are a bunch of underpaid unhappy government employees. They don't want to answer your questions. If you call, they transfer you to 5 different voice mail boxes before disconnecting your call. Good luck getting any sort of response from them.

It might be easier to see if they have a website for your state dept. of Labor. Ours has one and you can select the employer or the employee option. From there it navigates through it... whichever direction you need to go to find out the information you are looking for.

It's difficult to follow the laws if you don't know what they are. I had the benefit of working in a very large HR department for two years and got to know the law intimately. However... not everyone has that experience. You just have to be smarter than the average bear and be able to look.

You know it would be neat to see if we could find a few states dept of labor online... anyone else game? We could post the links here. Then if I could add the link to this thread at the top of the forum.
