Form Require To Spray Nude? - tanTALK

Happy Veterans Day Everyone!

This questions may asked in the past but thing may change since then so I just have to ask again.

Is that illegal to spray a "Nude" Male or Female customers? If so, do you Require them to sign any kind of Form to protect the business?

I'm a Male Spray Tech and the Owner, I used to had the previous owner's wife to do the spray tan since I took over the salon, but I wanted to make more money so I decided to learn and do it my own instead paying her to do it, I only have one female part time employee working for me but she just started to learn so I'm not confidence to let her any spray.

Anyway, a mother and daughter walked in on Saturday and wanted to do spray tan for the daughter and asked for her (previous owner's wife), and I say I'm the new owner and I will going to do spray tan , and she say what about if she want to spray Nude? I say if that is what you want and I will going to do it as long you ok with it, she say " you know that is illegal to spray a female customer because you are male" with a HUGE attitude, I say well, I didn't tell her or require the customers to take off everything in order for me to do spray tan , but if that is what you want and I will going to do it, I had done few Nude female customers due to their job or events so I'm fine with it, so they turn around left for about 30min. and came back due to the other salons are closed, so eventually I done the daughter spray tan with her bathing suits on, and at the end she told me with much friendly voice " I think you did better than her" , what a good complement and good feeling after a legal or illegal conversation!!!

Hi Ka726,

It can be illegal to spray tan someone in the nude if they are underage.

Sadly, this is a gender-biased question. I would suggest that you err on the side of caution and spray tan only overage girls in the nude. (Meaning they are nude, haha, my phrasing makes it seem like you are nude--that is definitely not recommended!)

I have heard of salons who do spray tan underage girls topless, but these sprays are always done with parental supervision/confirmation and only by a female spray tan consultant.

It's also important to remember:
--If you are not properly licensed you can not legally touch any of your clients.
--if your clients are going "full nude", then make sure they are out of sight of your other customers.

Speaking personally: if you are wondering if it's illegal or not--that's a pretty good indicator that this lies on some shaky ground that should probably not be tread.

haha, OK I will going to be completely Nude and spray a Nude customers, that is so funny and just kidding.

Yea I had her mother in the room with her on Saturday just in case any happen.

I will never going to touch any of them but may be the Hair Net if necessarily, absolutely nothing physically touch and the room is completely blocked/closed, so nobody will going to see through.

I wouldn't touch that, (literally). As a male spraying females nude is putting yourself in a sticky situation as is, let alone underage nude females.

Customers aren't exactly known for their honesty and god knows what kind of allegations they could throw your way, especially w/no cameras to offer proof of no impropriety for you to protect yourself.

No way is the cost of a spray tan worth your business IMHO.

Of course I will never put myself or my business in jeopardy, so what would you do "If you are/were me" if the customers wanted to spray nude?

That is why I'm thinking to make a " Spray Tan Form" specifically for those who want to spray nude to sign!

Me personally, I would absolutely have a female for female nudes and of course, you continue to do the males.

The verbiage inserted into your waiver is a great idea anyway. I know you are trying to save $, but in nude cases I really think it's more important to protect yourself and your business.

Remember, if you are offering a spray tanning service, then it's important for you to staff that service properly. In the interest of saving $ and payroll you could have female nudes by appointment only.

Just lookin out for ya!

Good point Turbo Girl.

At our training program we hire a female spray tan consultant to come in for the hands on training portion of the class when there are women in the classes.

This is not only for legal purposes, but also for the comfort of the women: this may be a point you should consider ka726--not all women are going to be comfortable getting undressed and being sprayed by a male consultant, even if it is perfectly legal. I'm sure that some will, but I am willing to bet that an even larger number would rather it be a woman anyways.

It does stink that it's going to cut into your immediate profits, but if you are giving the client what they want then in the long run you will be making that money anyways (and hopefully more!)

You are in Alaska right? How is your business over there if you don't mind I asked? I always fascinating about Alaska, love all the TV show about Alaska --- Ultimate Survival Alaska, Life Below Zero, Yukon Men..... Everything so Beautiful and the people are Awesome, really wish I could be there one day --- Am I allow to talked about this thing here :-)

Yep, UV business is phenomenal here since we have 7 months of dark, very cold winter and people desperately need Vitamin D. It's the only thing that has gotten me through 26 years at -60 and -70 degree temps!

On the reverse side, during our 3 months of summer our sprays do great since it is very sunny daylight 24 hours a day. So, luckily for us tanning is a necessity here even with all the bad press.

Everyone should visit at least once before you die!
