Spray tanning - tax?

Hi everyone - To date, everything I've been reading about the new tanning taxes from 2010 indicated that this only applies to UV tanning.... until today. I stumbled upon two very reputable spray tanning salons that both indicated that they were advised that the new tax does apply to spray tanning. Has anyone heard about this?

Thanks for your reply...

I'm interested to see the answer to this. Everything I have read said that the tax only applied to UV tanning.

The tax is for UV beds only. Does not apply to a "cosmetic applied spray tan". I checked with both my accountant and with the state when we were getting ready for this tax to go into effect.
Still not sure - contact your state and/or your accountant about it. They will be able to tell you.

Were they referring to a state sales tax in their area?

Thanks for this info - - I'll def contact my tax accountant and see if she has any insight on this. If I receive any different info, I'll let everyone know.

Ken - the salon was referring to the recent "tanning tax" with the new health care reform law that was passed... they said there isn't a state tax on the "service" itself.

I'll let you know any new info I find out! Thanks!

Re: Spray tanning - tax?

In Washington State the tax applies to Sunless tanning as well. Here is the info from the Dept of Revenue website.

Sunless Tanning is a Retail Sale
Background Sunless tanning, also referred to as spray tanning, airbrush tanning, or UV-free tanning,
is a common alternative to the traditional bed tanning. Sunless tanning is the application
of chemicals to the skin to produce an effect similar in appearance to a traditional
suntan. The chemicals can be applied via machine, a person using an airbrush, or
manually using a lotion/cream. Sunless tanning generally involves the use of lotions and
sprays that contain dihydroxyacetone (DHA) as the active ingredient.
Charges for sunless tanning, like traditional bed tanning, are retail sales subject to
the retailing B&O tax and retail sales tax. These charges are retail sales regardless of
whether the business provides both sunless and traditional bed tanning, or provides only
sunless tanning
