Question: So, since I spray in my home (dedicated room/spa set-up) and I am sole propriotor of my buisness, do you think I need an unbrella policy on my homeowners insurance to cover any possible 'occurances' that could be realted to my buisness...for example, the person that 'claims' they have to get corrective eye surgery because some spray got into their eyes... lol. Or something like that... you get what I mean. Or would anybody suggest paying to become a LLC (Limited Liability Co)? I have been in buisness for myself for years, just not in sunless tanning. My other buisness would have no personal liability so this is new to me. I am so afraid of setting my family up for potentially being wiped out by some 'crazy' or sue-happy client. Thanks |

Sole Prop vs LLC - more personal liability 2. In your home - zoning issues? 3. Homeowners policy won't extend to a business within the home. As an aside: I also would be EXTREMELY leery of having people in your home for this!!! First - they learn where you live, what you own, etc etc Second - both you and the client are at greater perceived risk. You are asking them to come into your home, take off their clothes, and have a "personal service" performed. I wouldn't feel comfortable doing it as a client, and I would SUSPECT you would be MUCH more likely to attract the perverts that ARE out there! There was just a story on CNN yesterday about a couple that advertised a diamond ring for sale on Craigslist for $1050. A "couple" came to look at it in their home. They turned out to be robbers, two other men came in to join the robbery. The mother, father and two teens were put in plastic handcuffs. The older teen was struggling or being hit and the dad tried to intervene. The dad was shot and killed. Meanwhile the mom was being kicked in the head. I believe a "business" location - with other business neighbors within view etc would be much safer for you than your home. But to your question - consult an attorney and your insurance rep! |

I need to be selective (point taken), and only take clients that I personaly know in my home or referals from those clients. As a side note, technically, no body comes 'in' my home. I have an outside entrance to a room off the garage.... but, point still taken! I have been considering being mobile but that has it's own issues as well. (My gosh, it is so sad that we live in a world that we have to be constantly worried about being robbed, beaten, raped, or sued.) I have a medical mal-practice attourny friend, I will get his opinions on insurance coverage as well. I have heard that LLC's do not provide the coverage that people think they do. I will dig deaper on that option. Does anybody have a good template for 'Waives/Disclaimers' that they have their clients sign? Thank you for all that have replied...I am taking it all in :) |

What I am writing to you may seem long so I am sorry for the length but this is a warning of what can happen to you. To all you new and existing mobile spray tan companies out there...this is a VERY important lesson to learn from if you have mobile spray tan rivals/competitors. There is this mobile spray tan company(and I read that some of you use their products) that is trying in every way I guess to sabotage me. They recently opened a very small salon just for spray tanning so now you can go to them or they can still come to you. Well, I've been doing spray tanning for 5 years now and have had only 1 complaint from a client.(I fixed her tan for free ofcourse and she became my repeat client) When I am overbooked and my techs are booked as well, I outsource to a mobile spray tan company I trust and know their work. I had to do that quite a few times now and I follow-up with the client to see how they like their tan from the girl I outsource them to and they tell me they love their spray tan and the technician was very friendly and knowledgeable. Customer Service is huge for me. Anyhow, last week I booked a spray tan with a female client and 2 of her relatives. I had something come up so I couldn't tend to her that day of her session and I told her that the other girl was going to tend to her and if she has any questions to give me a call. So on Saturday the tech went to the clients house and spray tanned the client and her relatives. The client was very rude to the tech, asking all kinds of questions about the ingredients and the spray tanning process.(Mind you they mentioned that they got spray tanned before) While one of the girls was getting spray tanned she was moving around and touching her tan and just being careless and got spots from it. The tech told her by doing that she is going to mess up her tan, well what do you know she did so she showered because she was a mess. After she showered she got spray tanned again. She ended up getting small red bumps on her arms(her sister that called me claims) hmmm.....what was she washing with? From what I was told, they were asking why didn't Pardise Airbrush Tanning show up and they strictly wanted me to spray tan them. Then they were complaining that we didn't take credit cards. So the client who booked with me called saying that she just got spray tanned and complained it got very blotchy on all of them and that she was very very dark.(I was told by the tech they wanted to be very dark and she warned them about that but they insisted) And one girl was wearing a Tiffany bracelet and the tech mentioned to her about wearing it during a spray tan but the girl insisted on wearing it and didn't want to take it off. Another girl was supposedly sent to the hospital because of the red bumps she got.(She got the red bumps on her arm while getting the 2nd spray tan which was after she got out of the shower) So when the main girl who booked me called complaining, she wanted to make a claim, asked for my lawyers number and insurance number(Insurtecinc.com) and wanted me to pay for her sisters doctors bill and for her photographers cancellation deposit fee that she had the next day. Now all three girls signed waivers. Those waivers are very detailed to cover ourselves. Guess what people. The whole thing was planned and set up by the rival mobile tanning company. I did some research on facebook about the girl that booked me and she had my rivals/competitors company on her facebook page and she had a picture on her facebook of one of the owners of the mobile spray tan company at her house having a good time. Oh on top of that, the tech that I sent out to spray tan them, she was spray tanning the owners of the spray tan company. The waivers they signed, the owners put fake names. WTF? So if you have any rivals out there, be carefull of what they might do to you, they can be very evil and also, check id to make sure it's the person you are spray tanning and not your rival. Dang I am just imagining what would happened if I went to spray tan them. This whole incident happened to us yesterday. I am in shock that competitors would go to such lengths to take someone out. I can also imagine what the owners are thinking now since I didn't show up. Oh and prior to this incident, a couple of days ago the rival owners were bashing me on twitter using the name Paradise which is obvious they are pointing to me. So yeah just a warning for all and sorry this is so long but thought it would be helpful to many. They are very unprofessional and evil. |
