She called me last night crying & saying that she felt like I was doing her wrong. She has worked really hard for this position (true) & she felt like she didn't deserve this. Apparently she obtained a Dr. Excuse & she plans on giving that to me today. She told me that if I was going to demote her for not tanning than I might as well just lay her off because she is not going to move down.
I callled her back & her husband & I got into a heated debate. He said he personally felt that it was unsafe to tan during pregnancy. I asked him why he felt that way & he said "because that's what the Dr. says". **AAAAAAAAAAGGGGGGGGGGHHHHHH** They both refuse to listen to the facts. The fact of the matter is that she is very dependable & an excellent salesperson. She was a bed cleaner for a year and she was promoted to the front where she has done very well. She's definately not the brightest person but still a good employee. My business side is telling me she's outta here...but my heart hurt to listen to her cry. I thought about making her sign an agreement if I was to keep her employeed. Guidelines such as: -she is to inform pregnant women to always check with their doctor before tanning but she must give them the FACTS & not ever mention her husbands stance on the situation. -If someone asks her why she's not tanning, for her to give a reasonable excuse...maybe she's uncomfortable, makes her nauseated, etc. I would appreciate your feedback.

What's her husband got to do with her being employed with you? I wouldn't give him the time of day, you sign the paycheck for her not him. WOW that would set me off. If he talked to me on the phone I'd say I'm sorry you're not on my payroll and I have business to run here. (hang up)
If she's a good employee and means that much to you keep her. Maybe when she starts to get fat and depressed over the winter she'll start tanning a few minutes here and there. Angelcat I got thinking you are also pregnant, people are going to see you tanning. I'm going to guess you will be the healthy one and reflect that to your customers anyway. Just let your pregnant customers know you tan because it really makes you feel good.

This is probably the 15th attempt at typing something that makes sense but WHAT THE ****? This isn't a LIQUOR STORE.
I honestly have no idea what to tell you. I'd toss her. YOU HAVE TO MAKE MONEY. If she starts running her mouth about the dangers of tanning then YOU HAVE A BUSINESS TO RUN AND YOU ARE PAYING SOMEONE TO DESTROY IT. OR she keeps her face shut and says WHAT when people ask why she's so god dam pale. OR you can experiment on her with different self tanners to see what works best BUT will she be stupid enough to think that trying different self tanners on herself is not going to do damage? This is bothering me and I don't even know you people.

Oh yeah, YOU ARE ALSO PREGNANT.
KEEP HER. Use her stupid *** for the look of DEATH and you can be the sign of life. NOW, when YOU tan, do half sessions so you don't over heat. Remember, you only need to tan to 1MED to get your dose of Vitamin D (or a decent amount at least). Let her work there and just work with her I guess. If you start to get a vibe about some BS going down bring it up to her. People are going to ask. You are with child, why are you tanning or not tanning and just explain it to them. YOU talked with SCIENTISTS that claim it's ok. She talked to her drug dealer MD and he says a healthy child is no good for his business.

This whole mess is just plain dumb! Fine, she (her husband) does not want to UV tan, but there is no goddamn reason she cannot spray tan here and there to keep her color.
She is an employee at a tanning salon WHERE PART OF THE JOB REQUIRES HER TO BE TAN! You can easlly boot her for not complying with company policy. And there is no reason you can't demote her down to bed cleaner. if she doesn't like it, tuff ****, quit!!!

Angelcat, before you do anything you need to talk to a lawyer about what you can and can not do with this employee. The law says that you can not discriminate against someone that is expecting. You could open up a can of worms that would not be in your favor.
Some of the people on here are telling you they would do this or they would do that, but their salon is not on the line, yours is. I would be very carefull about how you proceed with this employee. You need to cross every t and dot every i because if you don't, it may be her salon and not yours. |

Several exceptions to the doctrine exist, especially if unlawful discrimination is involved regarding the termination of an employee.
Unlawful discrimination can be characterised disparate treatment or, by contrast as disparate impact (also known as adverse impact) discrimination. Disparate treatment discrimination involves intentionally treating someone less favourably than another person because of an attribute (such as race, color, religion, sex, national origin, age, disability status, or military status), compared with someone without that attribute in the same circumstances. I have 45 Firefighters that I am a supervisor over. Every year or two I have to attend several classes that deal with discrimination and I am telling you that you need to be very carefull on how you proceed with this situation. Navi and Engfant are saying that they would do this and they would do that, but are they going to help you come up with the money to start a new salon when their advice loses you this one.
