I don't know what the legal time frame would be for your area, but I would think that the employee should have turned the key over at the time that they quit. If not, then certainly before they picked up their last check it should be turned in along with any uniform they may have. Anytime an employee that would have a key to our salon has been let go or quit, we have the locksmith rekey the doors. It's really inexpensive and assures us that only authorized persons will be getting in. Good Luck.

Annie,
Make sure when you talk to the locksmith, you get a lock that YOU can change combination yourself, WITHOUT having to call the locksmith. You may have to try Lowe's, Home Depo, or the like, because selling the "change it yourself" models of combination locks cuts the locksmith out of "long term" re=keying profits and therefore lots of locksmiths won't carry/sell them. I used to hold 8 hours---part of thier training pay- As a Shirt/Key deposit. I have them sign a paper at teh time of hiring I am doings so. And if eth key and shirt is not returned within 24 hours of their termination they agree that I will use thier 8 hours to replace teh lock/ and keys. At which time they are welcome to keep the key.
Is it legal..dunno. Didn't care ...It worked for me. |

I would recommend that people check with their state's labor board before implementing any policy that hold's or takes money from an employee's paycheck. The gov has a “dog in this fight” namely, income and social security taxes so they are pre-disposed to pretend to be on the "Employee's" side (their side really).
In the one example of dealings I KNOW of with the State of Florida, a sister company, with join ownership and separate management, had one of their ex-employees complained to the state about one labor issue, and the state audited their payroll and policies back for 7 or 5 years, NOT only for the one labor issue complained about by the one ex-employee, but for ALL current AND past employees AND any labor issue. The mandated state settlement was sooo UGLY, the STATE proposed a payment plan! Granted, they got poked for a bunch of different infractions: Making employees managers for the purpose of avoiding overtime payments. Not paying employees for mandatory time spent “On-call”. And holding or taking money from an employee's paycheck, which was the smallest % compared to the first two, but still… Be careful, look before you leap! Tom |

I always get the key as they are quiting. If they call in and quit they dont get their last paycheck until it is returned. If they dont bring in the key I take the amount to change the locks out of their last paycheck. It works for me. Ive only had one girl try to tell me she wont give me they key until I pay her... It only took two mins for me to help her change her mind. LOL She brought me they key 5 mins later, and all was good.
