In reality, the FDA approved exposure times. Federal law is above state law. Some beds say 24 hours, some beds say 48 hours. The 24 hour rule shouldn't be too much of a problem, it is what many bed labels have called for anyway; and it should have already been enforced. Although if a customer is only a few minutes short of reaching 24 hours,it seems harmless to let them tan. The best way to keep customers is to let them know of the upcoming enforcement and wait until you get OFFICIAL NOTIFICATION in writing from the health department. At least your customers will feel like they were given time to adjust to the change.

I have talked to my state health dept. and was told if we let them tan a minute early we can and will be fined.

Every State is different. Violating the state law can be a Class A misdemeanor with fines up to $25,000. Again, every state is different. I was told at the Smart Tan certification class that the Texas fine for tanning a person under 24 hours was $10,000 per person. Believe me, I made my employees write that one down in their notes. We were shocked as ****, that the fine was that high! I will not tan a person that has any amount of time to wait. I don't care if it is one minute. You can obtain a copy of the rules from your State Health Department,in fact you should have received them when you applied for your license. Like i mentioned earlier, there are ways to "keep your customer" other than breaking the law and overexposing them! look at this as a way to build customer relations. Talk to them, offer them something, explain the law, tell them how much your value their skin, show em new products...the list could go on. Just find out what YOUR state requires.

We use Suntouch, which can be set to per day, or 23.5 hours. This gives them 1/2 hour lee-way. It can be over-ridden, but I am the only one in the studio with access to over ride. This forces the part-timers to educate their clients, and really go over the release with them. It's stated on the release form, and the client has to sign it, acknowledging that they understand how our studio works. If you had a real problem with a client, you could pull out that release and explain to them that they signed the agreement to policy, and then re-educate them on the importance of not overexposing themselves.

One other quick point...

You can also tell them that even though they may not BURN, (especially those very darkly tanned clients) they are still going to be over exposed, and that leads to photoaging, or, premature lines and wrinkles, and of course, NOBODY wants that... That's what has worked for me... then you can get them thinking about that, and sell them your Amino Genesis skincare line, formulated specifically for tanners.... repairs sun damage and makes them look all young and dewy fresh! Yay!

I advise the 24 or better 48 hour rule and infact dont like them coming in every day as that to me is overexposure and can in fact lead to tanning addiction and anyway you dont need to come in every day if you understand how your skin works!

We made the rule here...I called and the state even wants you to enforce it.
Dont know that anyone else does..
The problem was clients tanning at night and then coming in the first thing the next morning.
So we put it in effect. Some have problems remembering it, but I am not willing to lose my business because a customer gets peeed.
