I would not have my biz function in a non-legal way.
Hence, my request for opinions.
I will check with the state to see what the rules are for barter. Since I had not seen the subject come up in here, I thought I would see if anyone was utilizing it.

I pay the bed cleaners an hourly wage and they get a visit for their 4 hour shift also, tanning consultants tan whenever they want.

Having someone come in a basically volunteer to help clean beds is not against the law, since they are not employees workers comp. is not an issue. Since they are not deriving an income, why would the taxman care? Liability, maybe??

EZ is right - waaaay too risky for a serious business person to hire with this practice: workmen's comp is the #1 infraction - and fraud like that is VERY expensive... and imagine for one moment this worker is injured on the job for whatever reason... Nightmare waiting to happen... outside consultants? give me a break... no judge will ever accept that argument... since when is a bed cleaner an independent contractor?
Not worth the risk, in my opinion.

Since the "volunteer" cleaner is just that a volunteer, non if that would be an issue.
But if you're that scared of all the possible, yet unlikely legal hassles, don't do it. We are know how physically dangerous this business can be. Attack of the killer spray bottle?

Contract Labor: You may pay someone up to $599 and they do not have to claim it, anything over that amount would have to be issued as a 1099.

This sounds risky to me. Accidents do happen and people do love to sue. I would also worry about it giving customers the wrong impression.

You pay contractors for a variety of services. Building a room, cutting your grass, sweeping out your chimney....They are not on your payroll and therefore you are not responsible for their 1099, w-2 or workman's Comp. You just pay them. It is their own or their companies responsibility to claim (or not claim) the money. If you offer them a tan in exchange for their servics, it is still paying them.

I knew someone would ask me that! Darn, I should have been better prepared with an answer. I live in a fairly uptight suburban area and people like that our staff is fully trained and certified. Now, can a high schooler bartering for tanning clean a bed as good as paid staff? Probably. Some days probably even better. However, I'm not opposed to the barter system. I personally barter tanning for several services. Just not this one.
