I am a "newbe" just bought this business 3 months ago already established so far so good. I have somewhat of a legal question. In the business location the owners brother-in-law has a dentist office 2 doors down from me and I want to sell teeth whitening kits. Would this be considered "competing" I cant afford a lawyer but maybe you guys could help with this type of situation at least who I should contact in Delaware about the legal aspects of what I can and cant do? And asking the former owner is NOT anoption - that was a nightmare and a very soar subject with me. I'm so glad someone suggested this site -I can learn a lot from you guys and I thank you for your support in advance - you may get tired of me before long I'm one to ask questions. Lisa

Do you have a clause in you lease agreement regarding this?
Also, use the search tool to research some threads regarding whitening systems, you might change your mind about it...........

I think if you were selling the procedure that he was then yes but your not your selling a retail item to be used in a bed a service you provide but I don't know JMO

If you have a laywer or know one just call them up and ask them what they think. I have a great lawyer and I can call him and ask him questions without him charging...you might be surprised if you just call and ask. good luck in whatever you decide to do.

In our lease agreement it states that we cannot compete with other businesses in the mall. However, as long as we do not generate a significant portion of our revenue from product lines it seems to be ok. We have a shoe store down the street, but we sell thongs, sandals, etc. In other words, sell what you want until someone complains. My motto has always been...

It is better to ask forgiveness, then to ask permission!

I briefly tried selling colour care shampoo/conditioner & told the Hair/Skin salon owner - didn't want to undercut his prices. He freaked when I mentioned it even though he had no intention of carrying the line. I said I could complain the same that he sold self-tanner. He didn't pursue it. One of his hair dressers actually bought some of the shampoo from me because the owner wouldn't get it in. I doubt the dentist could complain anyway - even the kits they sell have a service component because they form the guards themselves. (and you wouldn't believe how cheap they get the kits for compared to the price they get! My salon was formerly a dentists office and I occassionally get their junk mail. Dentists are true rip-off artists.)

Thanks for the replies now that I FINALLY got in!!! Actually I'm still waiting to hear from Hollywood whites called left message emailed - no response anyone else out there who sells HW's - now for the important question Im researching on how to get people to tan in the winter haha right? To me as a former mental health professional well still am - the benefit of improved mood is a biggie - but as far as maintainence tanning any sugestions for a newsletter I'm working on - does anyone have a chart or guide for a beginer tanner and time frame for getting a good tan -I am an information junkie go figure and like to read studies - the beds list the charts week 1.... but do u advise customers to tan daily? Thanks

If you're in Canada, Renewed Enterprises is good. No pressure sales, so far at least! 1-877-991-4999. Hope it helps.

As for a guide for monitoring someone's tanning schedule, it really depends on the individual. Depending on the skin type, I would start anywhere between 5 - 10 minutes. On their way out, I'd ask them how they felt the session was and also take a good look at them. Upon their return, I'd ask them if they felt the session was too long for their liking, if they felt a little pink, or what not. Based on that, I would decide if I increase the minutes by 1 or 2, depending on their response and equipment type.

Regarding tanning everyday, not recommended at all! I try to keep 2 - 3 times a week. I try my hardest to prevent every day tanning. The only time I would do it is if I know they are not going to be able to tan for the next couple of days. (Long weekend, etc.)
