The Public Health Department states that a tanner/salon must abide by the recomended exposure time in Illinois. Which I agree with for clients who have not tanned before or it has been awhile since their last tan. What I am wondering is what about the clients who are coming from another salon down the street, who you can obviously see have tanned within the last day or two? I have new clients who throw a fit about this and would rather go back to the other salon because I will only let them tan for 6 min (depending on their skin type). Now these are the departments rules. I read that the FDA requires you to follow this chart for clients who are "building" up to the full time. The ones who are regular tanners (new ones)have already built to their full time. What can I do? anything?

I thought the recomened expose time was based on skin-type? The higher level the skin-type the more time they can go in for, keeping in mind hair color and other factors too. Wisconsin does not require us to start a new customer at the least ammount of time for that particular bed which is what you are saying Illinois requires you to do? They do require that we are trained in recognizing skin types and use our own judgement for tanning time. We always recommened a tanning time, if the customer has been tanning eleswhere they will usually ask for more time. We then ask if they where going the maximum time in the other beds, if so and thier skin appears so we tan them for the max in ours.

Skin type IV is only allowed to go for 8 minutes in a regular base bed (20 min). They have been tanning elsewhere for the max time at other salons (20 min). It says I should follow the recomended time exposure. Does this mean if they are new to tanning?

Yoco,

I am trying to locate the information with regards to the regulations in Illionis. I will get back to you with any information I can find.

I would assume that since the exposure times are "recommendations" that it would allow some leeway (spelling?) on selecting exposure times.

Keep this in mind, though, you have the right to actually ask that they produce for you a copy of the state's regulations or rules that "specifically" spells out what they are trying to require you to do. Any ambiguity in the reguations or rules will make it more difficult for them to enforce them.

Here is what I have found...
Quote:e) Operators shall limit each consumer to the maximum exposure time as recommended by the manufacturer, taking the consumer's skin type into consideration. Operators shall not allow use of tanning equipment by consumers who have used the services of a tanning facility within the immediately previous twenty-four (24) hours.

I don't see where it states that you have to follow the recommened exposure times to a tee.

I would fight this if I were you, but that is JMHO. The exposure times are "recommendations", and IMO that word leaves it open to intrepretation.

Wow, that's a very good question and you should definitely look into it. However here is a senario I have seen many times in my salon. Jane Doe comes in for a tan. Fill out all the paperwork and we determine she is a Type 3+. Normally we start her off at about 10 minutes. But wait, she has been tanning for 43 years at Try-N-Tan across town and she does the max. there. We give her 20 to stop the whining, she has her tan, & books for the next day. Next morning she calls to cancel, "I burnt, that's never happened before?" While we don't have your regs. yet, knock on wood, clients that come from another salon our always talked out of the max. time if we can. We ask them to humour us and try a reduce time at our salon. IN fact one particular client comes to mind. Did the max. at Try-N-Tan, got her down to 10 at mine. She called cause she burnt.

I always explain it like this, and it seems to work for almost every customer...

"All beds are different. Even if they are the same type of bed, the lamps in them may be different and the hours on the lamps will be different as well. 20 minutes in one bed may or may not be the equivalent to 20 minutes in another bed. So, to be on the smart side and to be sure you don't burn, I would prefer if you start with 15 minutes here. If you do okay with that, we will bump you up quickly. But it is always best to take it slow and start shorter when going into a different salon and different beds."

That, of course is paraphrasing it, as I don't always use the exact same words, but it is always along those lines.

I could do 15 minutes with a client but starting them on 8 minutes? Alot of customers would rather just stay where they are at....

I've have had some clients like that. Fine you wanna do what you did a Try-N-Tan? In the event you do burn, we are not responsible! I've also given clients from other salons 15 instead of the 20 they did over "there". Next time they come in, "You want 20 today?" "No, 15 is fine." It's happened, we've burned them!
