Rep Power: 0 | Sounds like some of you folks are being misinformed about a lotion manufacturer's ability to influence where a lotion can be sold, for how much, etc...Unless you have signed a contract with either the manufacturer or your distributor of that product you, the salon owner, can sell the product wherever, however, and for whatever you would like. "Rules" like the one mentioned above are more "intimidation tactics" to scare you into acting the way that the manufacturer wants you to. They are not "legally" enforceable against you. I believe that technically, if CT wanted to they could hold the distributor accountable for tracking down and discountinuing the sale of its products to an "online diverter"...but do you really think that this will never happen? If it did, I think the salon could simply find another distributor to buy the products from (unless of course there is a "Black List" of salons that are prohibited from having product sold to them...but I think that is illegal). "On premise" rules for Matahari would apply to only those of you that have signed the CT Exclusivity Agreement, where I believe that they state location of sale as one of the terms. The rest of salons can sell it however you want to. |

You should be ashamed, so many of us have lobbied aganist the horrid internet sellers and now you are becoming one of them. Or are you really a salon owner???? There would be many possible promotions you could do to push these items. Products that have not done well in my salon go to the clearance bin, and I always recoop my cost. |

I am not suggesting anything other than that the lotion manufacturers figure out a way to get a truly viable, enforceable way to stop diversion. They all keep talking about their efforts but in the end, produce no real result in eliminating the issue. In other words, my message is to the lotion manufacturer and sounds like this..."show me, don't tell me". I don't care how many attornies you have on staff or how much money you have spent on legal fees, just figure out a way to keep your products off the internet and I will gladly shut up. But do not try and fool me by implying that you've got the issue solved. I see that an increasing number of customers are becoming aware of the fact that they can get every major leading brand at salon cost via the internet...and it's killing the salons. Figuring out the solution to the problem is their job, not mine. But I do feel compelled to make certain that no other salon owners are "feeling comfortable" with the way that the leading lotion manufacturers are handling the issue of diversion. We need to put more pressure on the manufacturers or they will just keep talking like they have fixed everything...and some of us are in danger of believing them. Just look at Alohatan's comments above (I sorry, no offense intended Alohatan). |
