Re: Need Advice! Customer wants to upgrade her whole package?
Did your distributor suggest your pricing? You need to charge more than $3.00 on your equipment, re-vamp your price list and hire a lawyer to sue this "distributor".

Charges a $3 upgrade, not flat-out. I dont think a lawsuit is in order, I think she needs to just get educated. Buying without knowing what you are getting is NEVER a god choice!

Re: Need Advice! Customer wants to upgrade her whole package?
Law Encyclopedia:
False Advertising This entry contains information applicable to United States law only. False Advertising "Any advertising or promotion that misrepresents the nature, characteristics, qualities or geographic origin of goods, services or commercial activities" (Lanham Act, 15 U.S.C.A. § 1125(a)). Proof Requirement To prove that an advertisement is false, a plaintiff must prove five things: (1) a false statement of fact has been made about the advertiser's own or another person's goods, services, or commercial activity; (2) the statement either deceives or has the potential to deceive a substantial portion of its targeted audience; (3) the deception is also likely to affect the purchasing decisions of its audience; (4) the advertising involves goods or services in interstate commerce; and (5) the deception has either resulted in or is likely to result in injury to the plaintiff. The most heavily weighed factor is the advertisement's potential to injure a customer. The injury is usually attributed to money the consumer lost through a purchase that would not have been made had the advertisement not been misleading. False statements can be defined in two ways: those that are false on their face and those that are implicitly false.

Re: Need Advice! Customer wants to upgrade her whole package?
You seem to be missing the big picture. No where did she explicitly say her distributor say she was sold HP beds, there is no direct quote. She said she was believed to be told - but then she says she has no clue what an HP bed is!
I am betting the dist said they have HP facials and she interpreted that to mean they are HP beds.

Re: Need Advice! Customer wants to upgrade her whole package?
Esglow, these beds are not HP beds, they are at most vhr beds with HP facials. A true HP bed that is new is going to cost $30-50,000 each.

Re: Need Advice! Customer wants to upgrade her whole package?
yeah shes new and will learn. especially if she sticks around here and post.
definitley STOP calling those beds HP you could end up in your own lawsuit. nevermind suing the disty! SIMPLE SCENARIO: a unknowing client of yours buys what you call HP then brags to her friend who really knows what HP is of her super low unlimited month price, prompting the educated friend to come to your salon and see a basic VHR bed.....I CAN END IT THERE NOT COOL! NOT TO MENTION YOUR COMP IS PROBABLY USING THIS AGAINST YOU AND LAUGHING THE WHOLE TIME! If you want to be a serious salon (and i beleive u do) you need to change this NOW!~ go to http://www.cosmedico.com/north_am/highpressure.php and read about lamps.

Re: Need Advice! Customer wants to upgrade her whole package?
I am totally getting the point -- I'm sure her distributor told her what they needed, to close the sale. I am asking if they told her what her pricing structure, to "make a killing" in this industry should be as well. IMO -- shady salespeople should be called out and held accountable.

Re: Need Advice! Customer wants to upgrade her whole package?
missmojorising, I would hate to find out how much she paid. And you are right though, dists that take advantage of people tick me off.
Esglow, did your dist flat out say these are full HP beds? Maybe this should go to IP and maybe I dont want to ask, but about how much did you pay? I fear paying for HP beds and not getting them :(
