IMO Nichesoft has done that and TanMan will not budge. He says they misled them, Nichesoft says they didn't. I've never seen the letter he claims his accountant sent in this thread and I'd be willing to bet that if he had it we would have seen it by now - I guess we'll find out soon enough now that I've posted this. Either way, he's being stubborn.

NEWOWNER...They offered fair compensation...2 yrs tech support doesn't mean squat when business is tight and I need the money in my account! Why prepay for 2 yrs tech support because they screwed up!!
Also, I am not budging because, again, I need the money more than the tech support. and Jeff Oakes REFUSES to discuss the issue with me at all. Why should I bend for an as*hole that can't even deal with his customers. You say that "Nichesoft is no Microsoft", well then why does the owner have his head so far up his as* that he thinks he doesn't need to speak with his customers to resolve problems! When he decides to bugde and talk...maybe I will too.
As far as the letter from my credit card processor, my attorney advised me to hold it and only show it if necessary. But yes I do have it and that is why I won the dispute with the credit card I had charged the progam with. That was my proof that helped me win, hands down!!

One last thing...ever hear of the word PRINCIPLE!!! Well, this is a matter of principle. I bought something based on what I thought was a professional opinion (Rachel fro Nichesoft), installed the program based on that, and found out by trying it, that SHE WAS WRONG! So, since Nichesoft was wrong, Nichesoft pays...BOTTOM LINE. If you need any other "proof" or "facts", you can look back in the thread and get my number and call me!

I think this thread is starting to go nowhere fast. Unless you have something other than an opinion, please do not contribute at this time. We are not a legal team by any means. Lets see how this fans out, there are two sides to every story and it sounds like the courts may be final arbitration, not us.

If misrepresentation can be proven, the law is clear.
