You just don't seem to get it, do you. Your tactics are USELESS. 10 times worse than what? Where do you think the next gigantic slap to this industry is coming from? While you guys are patting yourselves on the back, for averting "disaster", the FDA with whom you have been negotiating, is plotting another "disaster" for us, 10 times worse than the on you say you just averted.

I really am not trying to knock past efforts, except to say the obvious; they did not work and they are not going to work. Other than that, everything is great, no worries. Just give another $200 to the ITA.

YOU DO NOT HAVE A CLUE DO YOU?

Nobody patted themselves on the back. We successfully navigated the first round which could have been disastrous to the industry. Because we "managed" that first round they are now coming back again. This is the way government works. We have never stopped and are already hard at work on this next round. What have you done? Do you even know what is going on? What is your game plan? How much money and time do you contribute to bettering our industry? Take some of this energy you are using now and do something productive with it.

Put your "constructive criticism" on paper. Specifically. Not just "get a new plan". Like what? What do you think the current "plan" is that needs to be changed??

You don't have "all the answers" and "nobody does"? Fine - so the ITA doesn't have "all the answers" either. Nor ASA, Smart Tan etc.

But individuals, LIKE YOU, are taking their time, money and effort to TRY.

Try. Identify, specifically, what is "wrong". And what would be better.

Based on what? Can you give specifics please? For that specific thing that was done that did NOT work, what would you have preferred to have done instead and what do you project the outcomes of that would have been?


Is your assumption that those volunteering their service to the ITA, ASA, Smart Tan etc - who have a LOT more riding on the success of this industry than most - WANT it to fail? Or are just too stupid to know what would be successful?

So, if what you say is true, when where does it all end? In the same place, with a non-existent industry. All you are doing is slowing down, a little bit, the inevitable. You have to do something to change the game, or, by your own admission, you will no doubt lose anyway, because, as you say, they will not stop, UNLESS we do something DIFFERENT to change the game.

So all the rah rah speeches in the world won't rally the tanning base, when all you have to offer is the slow, but, inevitable destruction of the livelihoods of 100,000 Americans.

Ps-I a not a high energy person; just sittin around waiting for GA AU game to start.

Well, have they worked? Is the industry safe, is the momentum in our favor? This whole thread is based upon the fact that we have LOST every major regulatory battle, and we are about to be knocked out with a FDA haymaker. Do you think that we are stupid? is your last name Gruber?

Robert,how did the ITA manage the first round and what was accomplished?I am on board with the ITA smart tan and everyone else.I think people like wrecker and kooky need some examples of what was accomplished.Specifically,how could it have been ten times worse?

And for those of you too young to remember in 1995 the derms took us to the FDA to try and get us BANNED,SHUT DOWN.They lost then.That was the derms trying to convince the FDA to do this.Now it is the FDA that wants this.This time it is different.Your govt is more corrupt than ever.The lies about our industry are believed by many.Perception is not on our side,science is,but in politics facts don't seem to matter.

What was originally proposed and sought by the derms was much much worse then what we ended up with from the FDA. The new FDA rule (Class II medical device) and accompanying policy is something we as an industry can except. It does not place any undue financial hardships and restrictions on our industry. The ITA spent a lot of time and money making sure as best they could the outcome would not devastate our industry. This was accomplished! The industry as a whole owes the ITA a big thank you and job well done.

What could have happened:
Each tanning bed would require a separate 510K
Tanning beds without 510K could no longer be sold
Tanning beds from manufactures no longer in business could no longer be used

UV2021 it is still the Derms using their political influence that is driving these battles.
and on and on and on

I actually think John Overstreet has been the best I've seen him the past year. That's not saying he wasn't the best before I just mean with my experience he's answered every one of my emails and calls almost instantly. I'm concerned like you say Robert this time it's the FDA wanting this. I attended the 12 hour FDA meeting in DC I think it was 3 or 4 years ago now. I thought well the FDA moves slow we should be good for a while but this is different now. I won't be commenting much in a public forum this stuff belongs in professional private forums where as I call them the anti-tanners can't follow us.

I also attended several ITA organized meetings and a board meeting in DC, Nashville and NJ. I supported Dan Humiston for Congress when he ran. I try to stay tuned into the industry even though I've been making the transition to a spa.

When Brian used to yell at me and mock me saying stick to tanning only I diversified. Going on our 10th year now.
