Rep Power: 0 | Photo Copying Drivers License So the Heath Department came in for their yearly inspections... all good except he needs me to make a photo copy of drivers licenses for all my customers under the age of 27. Can this even be legal? ... and isn't it a huge liability for me? What if someone breaks in and steals the copies. And for some reason he wants me to have a hard copy attached to their enrollment forms. I'm having a big issue with this. Anyone have to do this? |

Rep Power: 21 | Re: Photo Copying Drivers License If it is not written in your state’s code, you do not need to do it; he is not a legislator. Check the codes for your state. If you do not see it, ask him to present evidence that you need to do it. Make sure you don't sound like a jerk. Just point out the liability issue and that it conflicts with privacy issues (and there are more than likely codes on the books for that).

Rep Power: 0 | Re: Photo Copying Drivers License It is actually in the code but regardless codes aren't always right...right? in my research .. and it's the beginning of my research.. I see that doing this could be a violation of the Patriot Act. I wouldn't have anyone photocopy my license personally. I know hotels sometimes do but they shred it when you leave and I make sure they do. PLUS do they have to sign some kind of privecy statment if I'm holding that information. I can totally be legit but I just want to cover myself and my customers. I can't imagine customers being ALL FOR IT! :) and I'm ALWAYS nice to the inspectors... :) |

Rep Power: 21 | Re: Photo Copying Drivers License You could fight it on the grounds of the Patriot Act or another angle, but you had better be ready to go to "lawyer land". IMO, I would just do it w/ a privacy statement and more on. When you employ someone, you must keep a copy of their ID on file at all times. Always best not to P.O. the inspector.

I require licenses be photo copied and no one has ever refused. I do keep them in a separate cabinet with the consent forms in the back; my tanning cards are in the front. Maybe you could somehow figure out a way to keep them somewhere safe tucked away?
