IM LOOKING FOR SOME HELP!!!!!

DOES ANYONE KNOW THIS GENTLEMAN MARC WILABY AND PATRICK FROM SUN ITALIA?????

MARC WILABY WORKS FOR PATRICK AT SUN ITALIA SELLING HP UNITS I PURCHASED 2 HP UNITS FROM THESE
GUYS AND I WAS TOLD I HAD TO PAY UPFRONT FOR THESE UNITS I PAID OVER 78,000 NOT INCLUDING SHIPPING
FOR A STANDUP AND MAGIC 636... NOW I FOUND OUT HOW MUCH THIS GUY MARC WAS TRYING TO
OVERCHARGE ME FOR SOME OTHER BEDS THAT I FOUND USED ONLINE AND SINCE I DIDNT
OVER PAY HIM FOR THESE OTHER MACHINES HIM AND PATRICK WILL NOT SHIP ME MY 2
SUNITALIA MACHINES THAT I HAVE A PAID IN FULL INVOICE FOR??? THEY WANT ME SEND
SEND MORE MONEY FOR THE BEDS I DIDNT BUY FROM HIM OR THEY WONT SEND ME THE
EQUIPMENT THAT I ALREADY PAID FOR!!!!

IS THIS NORMAL IN THE TANNING BUSINESS!!!!!!!!!!!!!!!!!!!!!!!

I CAN'T DO THAT. IF I CANCEL THE PAYMENT MARC WILL KEEP MY MONEY. HE THINKS THAT MONEY WAS OWED TO HIM.

This seems silly.......but turn off your caps lock please. It is harder to read when it is in all caps.


First - both Patryk and Marc have been in the industry for awhile - so they are "known". Doesn't mean you can't be having a bad experience with them of course.

Second - it is common to pay prior to shipping - so that is typical.


Now - as to if you can change an order or not prior to it being shipped............


Do you have any invoices or paperwork from either of them? What does it say regarding changes?

To buy a new Magic -- you pretty much are going to have to go through Patryk - although not necessarily Marc.

You could however buy OTHER High Pressure equipment if you wished to cancel this order. I would HIGHLY recommend the Matrix and they have both standup and laydown versions that would perform similarly to the Magic.


It sounds like the issue is:

- You sent Patryk (or was it Marc) $78K already. Was it a check or a credit card payment? If a check - has it been cashed?

- You were buying additional equipment just through Marc - yes? Was this new or used?

Did he claim to have these beds already in his inventory? Or did he go out and "find" and purchase them on your behalf?

What other beds were you buying and at what price? What has made you now think you were being overcharged? There is no "set" pricing for used beds necessarily. There are definitely "ballpark" values, and but you can always find some sellers that will "give it away" for much less because they are desparate. However, from a private seller (e.g. a salon owner) you also have to factor in the cost of removing it (if still in the salon), shipping it safely, new lamps -- and of course the installation itself.

When were the beds supposed to be shipped to you?

YES. HE IGNORED US FOR QUITE SOME TIME AFTER MARC TOLD HIM TO HOLD THE BEDS TILL HE GOT HIS MONEY,BUT HE'S STILL NOT GOING TO GIVE UP THE BEDS UNTIL MARC TELLS HIM HE CAN.

Yes. I have an invoice saying paid in full. Then when i bought the other bed(not through Marc) He got mad and sent another invoice saying he wanted 10,000 more.


It was two checks i sent Marc. He cashed them and put them in his bank account and sent Patryk his personal check. Thats how Marc hes control on the beds.

I only bought 4 beds through Marc and I have all the other beds in my control.

Marc doesn't have an inventory. He bought them from the owners of the companys,

I bought all kinds of beds. I know Marc was overcharging because his invoices were double the price of how much the beds should have been. I researched the beds with the owners of the company.

The beds will be shipped next month.

I would contact an attorney.

If you have invoices for the 2 Sun Italia beds saying "paid in full" and Patryk has acknowledged that he was paid by Marc on your behalf....while he probably doesn't want to side against Marc for fear he won't try to sell Sun Italia equipment in the future....I'd think, at the end of the day, he will make right by you.


However - your bigger issue is with Marc. I'd take the invoices and any email or written correspondence to an attorney. Find out what rights you have since you have not actually received the equipment yet. I would think (but I am NOT an attorney!) that if you normally have 3 business days to cancel a "contract", this "contract" wouldn't be complete until you had satisfactory installation or at least shipment (assuming that is part of the contract) and so would still be within your rights to cancel.


At the same time - if Patryk is "ignoring you", I'm not sure I would want to buy beds from his company. How will you be treated if you have service issues down the road?


I'd spend tonight digging out all your invoices and emails and call an attorney first thing in the morning.

As for this -- keep in mind, obviously Marc is in business to make money. If he found the beds for you, had them picked up, has been storing them, will be cleaning them up and freshly lamping them (?), and having them installed -- all of this has a cost. So it would be normal to expect that the price you would have paid for a USED bed that you found on your own and had to do all the "leg work" for would be less than what you would be charged to buy one through a broker like Marc.

And there is no "set" price for used beds - it can vary.

However, for new beds, normally that pricing is a bit more "set" and the saleperson/broker would be buying from the disty/manuf at a discount better than what you would have paid directly and so making their commission that way.
