Question Am I stupid? or just not getting this IRS example?

What is a qualified physical fitness facility?

A. A “qualified physical fitness facility” is a facility (i) in which the predominant business or activity is providing facilities, equipment and services to its members for purposes of exercise and physical fitness, (ii) indoor tanning services is not a substantial part of its business and, (iii) it does not offer tanning services to the public for a fee or offer different pricing options to its members based on indoor tanning services. To determine the predominant business or activity all facts and circumstances should be considered including, but not limited to, the following:
  • the cost of the equipment
  • variety of services offered
  • actual usage of services by customers
  • revenue generated by different services and
  • how the entity holds itself out to the public through advertising or other means.
My question: Is a gym liable to pay the new "Tan Tax"???

The gym up the street has both "Unlimited Tanning" and a "$5.00 Session" in their crappy little HEX and hunk of junk beds.

Is the unlimited tanning part of the gym membership? If yes, then no tax. If it is for a separate service on top of the gym membership, then yes they have to collect the tax (condition III is not satisfied here).

Jetman,

Seriously?

Folks, keep your emotions out of this tan tax and we all will be taken more seriously.

If a gym charges a seperate fee for tanning, then condition (iii) is not met AND they have to collect the tan tax. Gyms in my area do that so they have to collect the tan tax.

confusion pays the bills for the state. Make it so people are late on their payments and then you can charge more. Ask for clairification and you'll be directed to a CPA for a fee and then when the CPA screws up cause the working makes no sense it's still a late fee.

It's bullshot.

Rufusjack, you are so correct.
I'm sorry i got it wrong. The acutal words from the IRS are: "to difficulet to calculate and administer."

I guess the Gov't is giving back for the past Steriods focus.

I wonder if the HoR & Congress gym's have tanning beds? A way to exempt the free memberships these A-holes get.

What about The new Beauty Angel from Ergoline.(Red Light Therapy) We have one of them and if we sold that and had free tanning in tanning beds with it, would people still have to pay tax?

This is a tax on UV tanning services.!!!!! If you are a tanning salon and you submit that you made no money on your tanning services but $200,000 on 1 spray booth and a red light therapy booth...i'm sure the IRS will investigate.

Instead you could offer Handshakes for $15 and get a free tan. :) Call yourself a Handshake Salon or Shake & Slap Depot. You can guy 20 Handshakes and a pimpslap for $100 and you get 10 tans for free. NO TAX....HAHAHAHHA I love that idea.
