VICIOUS ATTACK...

MY PUPPY WAS ATTACKED BY ANOTHER DOG!

Okay... here is the story and I would love some advice...

on Thursday my kids take our little puppy out to pee. we have to take him out to the front yard, because the people behind us have a mean dog and he tries to get through the fence and get to my dogs. So the kids are out front with the two little dogs and they go next door to smell the neighbors yard, no big deal. Paisley sees someone coming and tells my son to grab "tanner" the puppy. Mead grabs Tanner and goes to our yard and sets down tanner... because in his little mind he thinks "okay, we are in the yard, all is good". This lady gets closer and starts YELLING "get your dogs, get your dogs" at my my kids. So tanner and lilly are at the sidewalk in front of our house barking at the lady's dog. The lady's dog PULLS from her, knocks her stroller over throwing her baby into the asphalt and then bites my sons jeans, scratches him up and then ATTACKS MY PUPPY. He grabs him by the neck and throws him around like a baby seal! My husband had to punch the dog in the side, thinking it would let go of our puppy, and it wouldn't. so my husband grabs the dog and throws it over our fence into the neighbors yard and when it hit the ground it finaly let go of my puppy and my puppy was able to run and hide.

My husband finaly coaxes my puppy out and he is bleeding out of his neck so badly. the woman comes up and starts yelling at my husband and screaming that our dogs should have been on a leash. let me tell you that SHE WAS ROLLER BLADING, PUSHING A STROLLER WITH HER BABY AND HOLDING ONTO A 70 POUND DOG.

My husband takes our puppy to our vet and they get him right in to surgery and he is all good right now. we just need to keep him in the crate for the next 10 days and keepy him from playing and jumping (PUPPY) and keep keep him clean.

My husband goes over later that night to talk to them and it turns out that it isn't even their dog. It is their neighbors dog. the neighbor is in italy for the next two weeks.

THEY CALLED THE POLICE ON US BECAUSE RALPH HIT THE DOG... forgot that part. They said they wanted to make sure that he hadn't hurt the dog.

Here is my dilema... WHAT THE **** DO I DO??? We could not afford the vet bill. I had to use my rent money to pay for it! AND is it my responsibility to pay for it, if her dog attacked my dog in my yard? She tried to say that our dog ran into the street to attack her dog... but then she also said that she was yelling at my son who had a dog in his hands... THAT WOULD BE TANNER.

WHAT WOULD YOU DO???

Re: VICIOUS ATTACK...

She obviously did not have control of her dog.
Take it from there,What are the local laws,If it is her fault then make her pay the vet bills and leave it at that.
If she refuses and it is her responsibility because she didn't have control then pursue it further.
I would start with some advice from the local animal control officer.
Good luck and sorry the little puppy got hurt not to mention the trauma on the children.

Re: VICIOUS ATTACK...

no. the police said that he could give us a ticket for our dogs being in the street and he could give her a ticket for whatever. but that he didn't want to give either of us a ticket. he said that it could be a civil matter if we wanted to go after them for vet bills.

it ****** me off... because my dogs weren't in the street. and according to him, as long as they are in my yard they are okay. well, he was conveniently attacked IN MY YARD.

the woman's account is always different. and I am sure she is going to get to the owner before me. she did say how ever that the owner is an older woman and she is just going to be "sick" over what her dog did to my dog and my son... I hope that means that she will feel responsible for what her dog did to my dog.

Re: VICIOUS ATTACK...

oh my kids were traumatized. so was my husband. when i picked up tanner from the vet and saw him for the first time and saw that he was okay, i started crying hysterically... it was the most happiest moment! one of the employees comes up to me with tears in her eyes and asked me how my husband was doing, and i thought that was sort of strange at first. and then i went to pay and two woman behind the counter were teary eyed too.

It turns out that my husnbad said he was pretty hysterical too when he took him in!

yes file a police report.. so when the people come back form italy ... they can also get a bill.. i would go as far as goign to small calims court or just sending a certified letter stating that you are requesting payment for vet bill, with copy of bill and give them 10 days to respond , if not small claims court.. but make sure you fill out hte police report....

Re: VICIOUS ATTACK...

TT & TT you should file a police report yourself. Did the police come and talk to you after she called them? If so what did they advise? It definetly sounds to me like it was her fault, and I think that you should make a few calls to the police, animal control officer, and the owner of the dog. You need to know if the dog is up on all of his shots. If the owner is out of town when they return, I would be sure to get to them as soon as possible so they know what problems their dog has caused. It may be that this dog has done this in the past and the animal control officer will know more about that.

I used to be a paralegal and we dealt with dog bites all the time. I sure am sorry that your family has had to experience this. good luck

YES... and that is the part that ****** me off! even if my dog was freaking out, she should have been able to control her dog! and she could have kicked my dog off if need be!

i have had two mastiffs that were 150 ponds each and one was a puller... never let go of him once.

also, when my husband threw the dog, his collar and lease came off... and he yelled at her that it should have been on tighter!

Bad advice!
Do your home work first,If not handled properly this could very well backfire.
