Tanning Troubles

Pikeville, NC -- One woman says she paid for twenty minutes, and she wants to use the 20 minutes. But the tanning salon says she can only use 7 minutes to start out.

They say, that's the law.

Gina Cochran loves tanning.

So when her husband bought her gift certificates for 2 months unlimited tanning at a new place near their home in Fremont, Gina was ecstatic, until she was told she'd have to wait about a week until she could tan the full 20 minutes.

She says that's not fair, Magic Tanning says that's the law.

A longtime tanner, Gina Cochran couldn't believe someone was telling her no.

"And I said, I mean I don't burn, I know this, I want the full 20, I mean that's what I paid for!"

But what she'd get is only seven minutes to start.

"Seven minutes is ridiculous, I mean I’m not going to drive down here every night for seven minutes."

Magic Tanning owner Deena Hare says,

"I can understand that, but for her safety and my liability for my business I have to be cautious."

Hare says she's just following the law.

"We will work your way up 3 minutes at a time."

Tanning bed operator Thomas Williams was there when Gina came in to tan.

"She wanted to know how long it would take to work up to 20 minutes, I told her about a week."

Tanning salons in North Carolina are supposed to follow a guideline of gradual tanning. Hare says,

"It depends on skin, and how new the bulbs are."

But as true tanners know, not every salon is that strict, at least that's what Gina's experience has always been.

"Are you telling me everyone else has broken the law for me?"

Now, she feels cheated.

"I want my money."

But the store policy clearly states, no refunds on gift certificates.

Reporter: "She's saying, is it really fair, I paid for the whole 20 minutes."

Williams: "Well, no that's not necessarily true because she paid to tan for 30, a month."

We asked, and the same policy goes for single sessions, you won't get the full times worth the first visit.

Bottom line, before you invest in tanning sessions, make sure you're willing to start slow.

Hare says Gina is welcome to tan by her rules, and they take those rules very seriously. So seriously they even fired a tanning bed operator because she went over the time limit, and burned.

Interesting... I have had someone come in recently and wanted to do the full time right from the start, I suggested doing the half time because she wasn't used to our beds/lamps and then told her it was merely my "suggestion" that she could do whatever time she wished because she in fact paid for it. But warned her that she'd burn. and low and behold she DID burn. Came back 3 days later and decided to listen to me after all... stupid b*tch!

What a joke! Do a story than tanning is very risky one day then the next do a story about salon owners being responsible but slant the story like they are cheating the customer.

Gina Cochran wouldnt be tanning at my salon after this news report. She needs to have her head examined. Had she been allowed to tan for 20 minutes and received 3rd degree burns she would have called the news station then too and hired Johnny Cochran. I could see it now, "If my client turned RED, the salon owner owes her BREAD"!.

had one the other day come in and ask if we were one of those places where you tell me how long i can go. i said that we would recommend her exposure time based on her skin type, tanning ability, and whether or not she has been doing any tanning recently. turned around, said i'm not paying to be told how long i should tan and left. gotta love it.

It's the parade of fools..this is what we get during season. Almost makes me miss those $200.00 days and people you could get to know and take more time to educate. These fools are all about "Like Quick Jack" it's March! When they should be maintaining ALLLLL YEAR long..ThAt's what we need to push as responsible tanning- maybe in November it wouldn't hurt so much. Stress "DON"T loose your base tan". This should be easier to do with the kind of tanning technology that is available today --maybe we could be become a less seasonal based industry (more pie all the way around)..push your best bed..8 min, 10 min, 12 min..whatever it is, once a week in off season..Some kind of "Be a responsible tanner...a "You Snooze You Loose" campaign.

Customers purchase "Sessions" at my salon...not 20 minutes each...
They also may not tan unless they sign a waiver that agrees to follow the rules & regulations of my salon. Period.
I get all the time people coming in here wanting to go 30 minutes in a 20 minute bed cause the beauty supply across the parking lot lets them....NOT!

Hello,
Your recent newscast was mentioned in a Tanning Industry message board and thought I would comment on the article.

The Tanning industry is, in fact, regulated by the Federal Government. Your article did a slight disservice to both your public and the tanning salon mentioned. North Carolina is the most heavily regulated state in terms of tanning salons, but this wasn't even the issue in your article. The Federal Government requires all tanning beds be regulated in terms of exposure, and every tanning bed piece of equipment must have this chart attached. Ignoring this recommendation would border on reckless endangerment. Despite the constant onslaught of Dermotologists, tanning salon operators are very concerned about the long term health and skin care of their customers.

Finally, North Carolina is very aggressive and strict about tanning regulations. I am in California, one of the most heavily regulated states, and even I was shocked at how regulated tanning is in NC. For example, inspectors come often to each salon and a single inspection can take up to several hours (even for the smallest of salons). They will look at individual records of customers, look at skin types, skin charts, and then compare with tanning history. They will even go so far as to check the individual bed's meter to see if it matches the records for tanning times. Any disparity brings a harsh and steep fine. Multiple infractions leads to your salon being closed.

Simply stated, all it takes is a single Gina Cochran to get thousands of dollars in fines from the state of North Carolina. Only a half dozen "Gina Cochrans" and your salon is closed by the inspector. I wouldn't be surprised if the inspector for that area doesn't start their customer searches (for other salons in the area) using Gina Cochran's name to see if other salons broke the law.

With the technicalities out of the way, I'd like to offer an opinion. This was an opportunity to educate the public about the dangers of overexposure, while enjoying the experience of tanning. Despite public perception, tanning to redness is unhealthy and actually increases the amount of time needed to tan. Red skin is damaged skin. The body is screaming, "I'm damaged." An efficient tan takes a full day to develop and will come about quicker when the skin is properly exposed to UVA and UVB. UVB creates melanin, and UVA oxidizes it to create the bronze appearance of the skin. Factors such as blood circulation, skin moisture and some others affect the speed and retention of a tan, but in all cases a sun burn stops the process until the skin heals. The point of this paragraph is that this is the reason the salon owner was completely right when sticking to the regulations. Just as the freeway sign's speed limit regulates public safety, the tanning exposure schedule protects the public from ignorance or abuse.

Just because my 2001 Honda CBR600 F4i sportbike can do 180mph on a surface street doesn't mean I should. The same principle applies to tanning.

Correct, NC is a highly regulated state and they have the ability to levie fines as well as shut you down for serious violations. Salons must pay a tax to the NC Dept. Of Radiation every year for every bed they have. My inspections have lasted 6 hours and they look at everything. This seems no different than if you owned a bar. As the owner, you have the responsiblity to limit the amount of alcohol one might drink. Perhaps Gina or the TV9 should have contacted the State for a clatification or explanation of the rules since it's the state that created them and not the individual salon owner. Also, it would seem that Gina paid for x visits, NOT x visits x 20 mintues each.
I've not heard of this salon before but they have my appreciation and admiration for standing up to this issue the way they did.

I can't understand these foolish people. I have been in the business for 8 years now. It seems like every other person knows everything about tanning there is to know. I love it when a regular comes out of the bed and they are looking great, at the same time your dealing with one of those characters. All their questions get answered right there.
