Rep Power: 0 | I hope...we can form a council of tanning salon owners....who can help our industry....if we do not answer or fight back....we will die....how can we accept being hit everyday...and we do nothing to fight back.....this is not a good trend....does anyone have passion...about tanning? If you do ...what should we do... |

Rep Power: 21 | I don’t see what the big deal is all about. 14? Come on people. How many 14 year olds do you tan now? Not many if any. I’ve been open for 2 years and I’ve never even been asked to tan a 14 year old. I live in a regulated state and I like it. Regulation helps keep us all on an even playing field. Those salons that break the law can end up paying for their recklessness in the way of fines or even being shut down. That’s a good thing if you ask me! The laws in NC are strict when it comes to tanning. We are required to keep the beds in their original form. We can’t play with lamps or time for sure! We are also required to get parental consent when tanning anyone under the age of 18. They also just passed a law stating the we can’t tan anyone under 13 without a prescription from their doctor. Go figure? What doctor would ever write a prescription for tanning anyway? I would say none at best. But so what! I don’t have any 13 year old customers anyway. Nor have I been approached by any 13 year olds that wanted to tan. I guess it happens but so far not to me. Even if it does I won’t care. Below is the latest law revision from North Carolina… GENERAL ASSEMBLY OF NORTH CAROLINA SESSION 2003 SESSION LAW 2004-157 SENATE BILL 657 AN ACT TO PROVIDE THAT OPERATORS OF TANNING EQUIPMENT SHALL PROVIDE WARNING STATEMENTS TO CONSUMERS REGARDING THE HAZARDS OF EXPOSURE TO ULTRAVIOLET RADIATION AND SHALL OBTAIN A CONSUMER'S ACKNOWLEDGMENT OF THE WARNING BEFORE THE CONSUMER'S INITIAL USE; TO PROVIDE THAT OPERATORS SHALL NOT ALLOW A PERSON 13 YEARS AND YOUNGER TO USE TANNING EQUIPMENT WITHOUT A WRITTEN PRESCRIPTION; TO PROHIBIT OPERATORS AND OWNERS FROM CLAIMING THAT USING TANNING EQUIPMENT IS SAFE; TO PERMIT THE RADIATION PROTECTION COMMISSION TO ADOPT RULES IMPLEMENTING THIS ACT THAT SHALL BE ENFORCED BY THE DEPARTMENT OF HEALTH AND HUMAN SERVICES; TO DEFINE THE TERMS "CONSUMER", "TANNING FACILITY", AND "TANNING EQUIPMENT"; AND TO MAKE THIS ACT EFFECTIVE OCTOBER 1, 2004. Whereas, on an average day in the United States, more than one million people visit indoor tanning salons for the purpose of tanning the skin; and Whereas, studies have found that indoor tanning may be just as harmful to the skin as outdoor sun exposure; and Whereas, most indoor tanning salon bulbs provide a significant amount of UVA and UVB radiation, both types of which are found in the outdoor sun and cause various types of damage to the skin that may lead to skin cancer; and Whereas, past studies have suggested that tanning beds contribute to the incidence of melanoma, and a recent study in the Journal of the National Cancer Institute indicates that the use of tanning devices may also contribute to the incidence of nonmelanoma skin cancers; and Whereas, dermatologists across the country are alarmed with the number of teenagers and young adults who continue to patronize tanning salons regardless of studies reporting the link between sun exposure and a wide array of skin cancers; and Whereas, the Centers for Disease Control and Prevention reports an estimated 700 emergency department visits per year related to tanning salon exposure; Now, therefore, The General Assembly of North Carolina enacts: SECTION 1. Chapter 104E of the General Statutes is amended by adding the following new section to read: "§ 104E-9.1. Restrictions on use and operation of tanning equipment. (a) Operators of tanning equipment and owners of tanning facilities subject to rules adopted pursuant to this Chapter shall comply with or ensure compliance with the following: (1) The operator shall provide to each consumer a warning statement that defines the potential hazards and consequences of exposure to ultraviolet radiation. Before allowing the consumer's initial use of the tanning equipment, the operator shall obtain the signature of the consumer on the warning statement acknowledging receipt of the warning. (2) The operator shall not allow a person 13 years and younger to use tanning equipment without a written prescription from the person's medical physician specifying the nature of the medical condition requiring the treatment, the number of visits, and the time of exposure for each visit. (3) Neither an operator nor an owner shall claim or distribute promotional materials that claim that using tanning equipment is safe or free from risk or that using tanning equipment will result in medical or health benefits. (b) The Commission may adopt, and the Department shall enforce, rules to implement this section. The requirements of this section are in addition to other rules adopted pursuant to this Chapter that are applicable to tanning facilities and do not conflict with this section. (c) As used in this section, unless the context requires otherwise, the term: (1) 'Consumer' means any individual who is provided access to a tanning facility that is subject to registration and regulation under this Chapter. (2) 'Tanning facility' means any location, place, area, structure, or business that provides consumers access to tanning equipment. For the purpose of this definition, tanning equipment registered to different persons at the same location and tanning equipment registered to the same person, but at separate locations, shall constitute separate tanning facilities. (3) 'Tanning equipment' means ultraviolet or other lamps and equipment containing such lamps intended to induce skin tanning through the irradiation of any part of the living human body with ultraviolet radiation." SECTION 2. This act becomes effective October 1, 2004. Rep Power: 0 | I am in California. The original proposal was to ban all tanning under 18, unless there was a doctor's perscription. However, it was amended to read anyone under 14. I have been open since September 2004 and I have been approached to tan a thirteen year old, and I turned them away. I have 14, 15, 16, and 17 year olds who tan. Some want a tan before a special occasion, some want to help their acne. Some tan for a few sessions, others are on EFT. When the original law was introduced banning anyone under 18, I contacted every member of the state assembly and senate and urged them to vote against it. I don't think the state should be telling parents that they are not smart enough to decide if their own children should be able to tan in a controlled environment. What would that have accomplished! All of the teens who were banned from tanning salons would then tan outdoors. If anyone thinks it is going to stop with the under 14 crowd, you are wrong. The same people who pushed for under 18, will come back and try again, they already have the under 14. If tanning should be allowed with a doctor's note, does that not suggest that there is merit in tanning. I already have to get a parent to come into my studio and sign a waiver giving their child permission to tan, should that not be enough. In my state a sixteen year old "child" can get a driver's license and have control of a dangerous, multi ton automobile, they can lay out in the sun all day long and burn to their hearts content, but will we let there be a day that the can not get a "smart" tan. I have a twelve year old son who would benefit from obtaining a gradual tan before he spends the summer in the pool. This ban and others like it are just the beginning of multiple laws restricting not only tanning for the young, but of other issues that a parent should decide. Think about these laws as they relate to you as a parent, think about these laws as they relate to you as a business owner. What's next...first 14, then 18, 21, 25....think about how many laws already exist that have taken away your right to decide for yourself. |

Rep Power: 21 | I live in an unregulated state & I do NOT like it. I wish there were some rules. I have let as young as 12 years old tan BUT they MUST not only have their parents signature on the contract but be with their parent everytime they tan and they are NEVER allowed to tan the max time (ex. if it a 20 minute bed they can go for 10 min). I don't like to even do that but I will lose business if I don't since all of the other salons will let them do whatever. The doctor's consent comes from Psoriosis cases(sorry about the spelling if it's wrong). Doctor's will write prescriptions for that. |
