Are all gift cards previously sold grandfathered?

No, I dont think so. Usually when a by-law is voted in Canada its ruling is effective on that day.

Re: Gift Cards? Certificates in Ontario

So a gift card sold in 1972 is still valid? That's not fair.

Re: Gift Cards? Certificates in Ontario

Can someone who has a giftcard from a store that is closed go and sue the owners after that law is passed?

No, a gift card with an expiration date would not be valid. After this law is in motion any card sold afterward wont have an expiration date on it.

No because it will only affect the ones sold after that law is ruled

Re: Gift Cards? Certificates in Ontario

Then they are grandfathered and the lady who brought that card to neon is SOL.

Re: Gift Cards? Certificates in Ontario

If that happened here which I pray it never does I would no longer sell so called gift certificates....I would come up with something similar to a gift certificate but it would be different name......theres always a way around it....Tell them you don't sell gift certificates you sell Season grams good through that season......I don't know thats not the best answer but there gotta be a solution.....UG UG UG as if small business isn't hard enough.....I just bought 400 dollars in Visa Gift cards as a bon voyage present for my mom and nana who are going on a cruise I paid 5.95 to activate them......perhaps you need to charge a feee like that to help recup the change!

Re: Gift Cards? Certificates in Ontario

I wonder if the law prohibits charging fees after a certain time period.....Like Visa first they charge 5.95 to activate for any card over 100.00 and 3.95 for any under.....then if you don't us it in 12 months after purchase they deduct x amount every month after 12 months......So say you purhcase $100.00 dollars but wait a year andf half to use it then its only worth $80 dollars.....
